The former president of Peru, Alejandro Toledo, who ruled between 2001 and 2006, will be released from the US prison in the next few days, once he pays the bail set by the judge, who decided to release him due to the risk of coronavirus.
In an extraordinary hearing held by telephone, Judge Thomas Hixson of the Northern District Court of California ordered that Toledo be released immediately confined at home in the San Francisco Bay Area (where there is a mandatory containment order) with a GPS surveillance system.
Toledo is 74 years old and suffers from hypertension, so his defense assures that he has a 6% chance of dying in case of contract COVID-19, significantly higher than the population mean.
The exmandatario thus achieved what his defense had been insistently seeking since the time of his arrest in July last year and after the bail It had been denied up to two times by two different magistrates, the first time last year and the second time earlier this month.
“The pandemic has changed Toledo’s ability to abandon U.S and entering another country, “said Hixson, thus reducing the risk of flight previously argued and that was used as a reason to deny him bail on the two previous occasions.
Toledo will leave the Maguire prison, in San Mateo county (California, USA), when his family and friends deposit a $ 500,000 cash bond and when his wife, Eliane Karp, hands over her passport to the authorities.
Although the initial amount to get out of prison is only $ 500,000, the total amount of the bond is one million dollars, since the other half of the money will be contributed in real estate in the USA by acquaintances of Toledo and that process can take several weeks.
In fact, the judge himself predicted that Toledo will still take at least a day or two to get out of prison, estimating that this is the time it will take to collect the cash. Furthermore, the GPS from which the monitoring will be carried out, it cannot be installed until Friday.
Hixson set the following conditions for bail: Toledo must be present physically or by phone at all future hearings held, all passports you possess will be withdrawn, you will not be able to drink excessive alcohol or drugs, and you must remain confined to your home except for medical needs, appearances before the Court and meetings with your lawyer.
During the hearing this Thursday, in which two friends and the wife of the former president were also present electronically, the judge specifically asked the two friends if they were still willing to deposit cash for bail ($ 150,000 between the two) after it was revealed that Eliane Karp has at least $ 700,000 in her name.
The discovery of this money – which neither Toledo nor his wife had declared before the Court despite the fact that they were required to reveal all their assets– It was another of the reasons that contributed to the earlier denial of his bail.
Toledo is accused of having received up to $ 35 million from construction company Odebrecht in exchange for favoring the Brazilian company in its business in Peru, when he was still president and has spent the last three years on the run from the Peruvian Justice in the San Francisco Bay Area (USA). The magistrate set the next hearing, also by phone, for March 26 at 11.00 local time (18.00 GMT).
